SPECIFIC INFORMATION ON THE DATA PROCESSING OPERATIONS

2.1. Personal data

Art. 4 No. 1 DS-GVO defines personal data as any information relating to an identified or identifiable natural person. Personal data are e.g. name, address, telephone number, e-mail address, bank details, credit card number.

2.2 Data processing for the performance of a contract

When you place an order with Be sCool Kft., we require personal data for the processing of the purchase, including the dispatch of your ordered goods, the processing of returns or complaints. Specifically, we need information about your name, address, e-mail address and any necessary payment data. The specification of your e-mail address is necessary to confirm receipt of your order, to notify you of the dispatch of your goods or to be able to contact you. The data processing is thus carried out for the purpose of fulfilling the contract.

You can also contact Be sCool Kft. before the contract is concluded and send us an enquiry by e-mail, for example, in order to receive advice from us. In this case, we process the data received from you, such as e-mail address and name, if applicable, with the purpose of carrying out a pre-contractual measure.

The legal basis for processing data for the purpose of fulfilling a contract or carrying out a pre-contractual measure as a result of an enquiry from the data subject is Art. 6 (1) b) DS-GVO.

In order to process your order, Be sCool Kft. passes on personal data to service partners such as payment service providers (including banks, Paypal, Amazon Pay, credit card companies) and shipping service providers (including DHL, DPD, Hermes, freight forwarders), insofar as this is necessary to fulfil your contract. It is also possible to pass on data to a supplier who delivers the goods directly to you. The transmitted data may only be used by the recipient to fulfil his task. Any use beyond this is not permitted.

We store the data required for processing the contract until the expiry of the statutory warranty periods.

We store the data required under commercial law and tax law in accordance with the legally prescribed retention periods pursuant to § 257 of the German Commercial Code (HGB) and § 147 of the German Fiscal Code (AO), in principle for a period of 10 years.

Personal data processed for the purpose of carrying out pre-contractual measures will be deleted within 12 months if no contract has been concluded.

2.3 Newsletter

You can subscribe to the Be sCool Kft. newsletter as part of the ordering process or separately via our shop page. In any case, we use the double opt-in procedure. This means that you will receive an e-mail from us with a link via which you, as the owner of the e-mail address, can confirm your subscription to the newsletter. We use the data you provide for advertising purposes after you have registered for the Be sCool Kft. newsletter. We will then inform you regularly about e.g. product news, promotions or sale actions.

The legal basis for this data processing is Art. 6 para. 1 a) DS-GVO. The data processing only takes place after explicit consent.

In addition, we store the registration data as part of the double opt-in procedure.

The legal basis for the collection and storage of this data is Art. 6 para. 1 f) DS-GVO. The data processing is carried out for the purpose of proving an existing consent. This is the necessary legitimate interest.

The dispatch of the newsletter as well as the storage and administration of the aforementioned data are carried out by Be sCool Kft.

The above data will not be passed on to third parties.

You can revoke your consent at any time with effect for the future. Each newsletter contains an unsubscribe link for this purpose. If you use the unsubscribe link, the newsletter for your email address will be unsubscribed directly. Furthermore, you can revoke your consent at any time by sending an email to info@belmil.de. The data record belonging to your email address can be stored for up to 3 years after unsubscribing for reasons of proof and to defend against legal claims. The relevant data record is then automatically deleted. The legal basis for this data processing is Art. 6 para. 1 f) DS-GVO.

2.4 Customer account

You have the option to create a Be sCool Kft. customer account. This password-protected personal account offers you a range of useful functions, including viewing your orders from the last 2 years, viewing and downloading your invoices, managing personal customer data, adding and editing different delivery addresses, storing a standard payment method and creating a personal notepad or wish list.

The legal basis for this data processing is Art. 6 para. 1 a) DS-GVO. The data processing only takes place after explicit consent. The data stored in the customer account will be saved as long as you have given your consent. You can revoke this consent at any time with effect for the future. An informal message to the contact data mentioned under point 1 is sufficient for this purpose. In the event of revocation of consent, your customer account including the data stored there will be deleted.

3.1 What are cookies?

"Cookies" are small text files that are stored on your data carrier and contain certain settings and data. We use cookies on our websites to ensure an optimal user experience for you, to compile statistics about the use of our websites and to enable marketing activities.

3.2 Personal Cookie Settings

When you visit the Be sCool Kft. shop for the first time or if you have deleted your browser data, we ask you with our Cookie Consent Tool whether we may use cookies and, if so, which cookies.

3.6 Technically necessary cookies from third-party providers

If you select certain payment methods such as Amazon Pay, Paypal, Barion, etc., cookies are set to enable payment with the respective payment method.

If we integrate elements of "Facelift Cloud" such as competitions or an advent calendar into our website and you call up this respective page with your browser, a cookie is set by "Facelift Cloud" for identification purposes and to prevent attacks against the server infrastructure of "Facelift Cloud". If you want to play YouTube videos embedded on Be sCool Kft., cookies are also set.

GOOGLE ANALYTICS AND GOOGLE TAG MANAGER

Be sCool Kft. uses Google Analytics and Google Tag Manager, web analytics services provided by Google Ireland Limited ("Google"), located at Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses tracking cookies. which allow an analysis of your use of the website. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States.

However, in the event that IP anonymisation is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Be sCool Kft. uses Google Analytics with the setting "anonymizeIP". This means that IP addresses are only processed in abbreviated form by Google Analytics in order to exclude the direct individualisation of persons.

GOOGLE RECAPTCHA

Be sCool Kft. uses the "Google reCAPTCHA" service on this website. The provider is Google Ireland Limited ("Google") with its registered office in Gordon House, Barrow Street, Dublin 4, Ireland. We use Google reCAPTCHA to prevent misuse through automated, machine data entry. This applies in particular to pages on which users enter certain form data and transmit it to our servers. Google reCAPTCHA makes it possible to distinguish between data input by a human and automated data input.

The service analyses the user's behaviour on the website in the background. Google reCAPTCHA uses certain characteristics to determine whether the website is being operated naturally. LOG FILES

When you visit the Be sCool Kft. website, your internet browser transmits usage data to our servers. Our server logs usage data in so-called log files. The following data is stored: Date and time, type of request, protocol type and status of the access, size and name of the file, IP address from which the request originates, referrer URL (information about the website from which you came to our website), information about the Internet browser used (e.g. which browser is used, the version number of this browser and the type of encryption).

We use log files to monitor the function and performance of our shop and to further develop and improve the Be sCool Kft. shop. For example, errors in the function of the shop are recorded, which are subsequently corrected by us. The storage of data in log files is also carried out for security reasons in order to ensure the secure operation of our system.

The legal basis for this data processing is Art. 6 para. 1 f) DS-GVO. The necessary legitimate interest consists of securing the function of the shop and ensuring the secure operation of our shop servers. IP addresses of users are deleted or anonymised after a maximum of 10 days.

CONTENT DELIVERY NETWORK (CDN)

Be sCool Kft. uses the service provider CDN77, DataCamp Ltd, London, which delivers certain content of the Be sCool Kft. shop page for us to you or your browser. This concerns, among other things, product images. On the one hand, the service provider enables a fast delivery of this data to you through its infrastructure. At the same time, the service provider will deliver the data from a server located as close to you as possible. Both minimise loading times and improve the user experience for you.

The CDN service provider always receives your IP address.

In principle, the CDN provider does not record any log data. Log data is only recorded in the event of errors for error analysis. The IP address is only stored anonymously and the log file is deleted after a maximum of 10 days.

SOCIAL MEDIA PLATFORMS

On the website of Be sCool Kft. you will find links to social media platforms of Facebook, Youtube, Instagram and Twitter where Be sCool Kft. is represented and offers content. These are static links. Be sCool Kft. does not use social media plugins.

Be sCool Kft. is represented in social media in order to get in contact with our customers, with interested parties and with other users and to inform about products, events or competitions. We would like to point out that personal data is collected and processed by the respective provider when visiting the corresponding pages. The legal basis for the processing of the users' personal data is Art. 6 (1) f) DS-GVO. The legitimate interest of Be sCool Kft. is the optimal design and improvement of the company presentation.

If you use our offers in the respective social network as a logged-in member, you have given your consent to data processing in accordance with Art. 6 (1) a) DS-GVO vis-à-vis the social media platform. In order to understand and improve our activities, we use corresponding evaluations in the form of statistics provided by the respective provider.

8.1 Facebook

Be sCool Kft. uses the technical platform of Facebook Ireland Ltd, 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland for the aforementioned information service.

Please note that you use this Facebook page including its functions on your own responsibility. This applies in particular to the use of interactive functions (e.g. commenting, sharing, rating).

When you visit our Facebook page, Facebook records your IP address, among other things. This and other information is used to provide us, as operators of the Facebook pages, with statistical data about the use of our Facebook page. Be sCool Kft. itself does not collect and process any further data from your direct use of Facebook. Only in the case of raffles or competitions is data processing possible. In these cases, we use e.g. contact data to get in touch with winners of our raffles. Be sCool Kft. uses the Facebook Insights software for a general evaluation of the Facebook page. Here we are provided with anonymised data from Facebook, which do not allow any conclusions to be drawn about individual users. As already mentioned, we use this statistical data from Facebook Insights to design and improve our offer on Facebook accordingly.

According to Facebook, Facebook stores your IP address when you visit our Facebook page. According to Facebook, this is anonymised and deleted after a storage period of 90 days (German IP addresses). In addition, Facebook stores information of the end devices you use for the visit. Through the assignment of IP addresses, it is possible that individual users can be identified.

Facebook stores cookies with your Facebook ID on your end device when you are logged in to Facebook. Through this cookie, Facebook can track your page views within Facebook. Be sCool Kft. as the responsible party has entered into an agreement with Facebook, which also regulates the conditions for using the Instagram page. Through the processing of information, it is possible for Facebook to distribute advertisements for its users via its own network. At the same time, data processing by Facebook enables Be sCool Kft. to use statistics provided by Facebook. This enables Be sCool Kft. to optimally design its own content and better reach its users. Parts of these statistics include demographic and geographic information. However, Be sCool Kft. has no influence on the underlying data. We are not aware of this data in its entirety.

It is likely that the data collected about you by Facebook Ltd. will be stored and processed outside the European Union. Facebook Inc. is certified under the US-EU data protection agreement "Privacy Shield" and thus undertakes to comply with EU data protection requirements.

The videos are made available on the video portal of YouTube LLC., 901 Cherry Ave., 94066 San Bruno, CA, USA, (YouTube) by the brands. In addition, Be sCool Kft. maintains its own YouTube channel.

YouTube is a subsidiary of Google LLC, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as "Google".

From time to time, you have the opportunity to participate in competitions on our website.
